Les Effets du Brexit sur les Procédures de Divorces
Toute procédure de divorce intentée avant le 31 Décembre 2020 doit se poursuivre dans le pays dans lequel elle a été initiée. L’Union Européenne (« UE ») et le Royaume-Uni ont tous deux indiqué que les procédures de divorce démarrées avant la fin de la période de transition du phénomène Brexit seront reconnues respectivement par la juridiction de l’un et de l’autre.
Les procédures de divorce après le 1er Janvier 2021
Si votre procédure de divorce a été initiée le, ou à partir du, 1er Janvier 2021, les règles post-Brexit s’appliqueront. Les Cours anglaises et galloises ont indiqué que la décision relative au lieu dans lequel les procédures de divorces doivent être initiées sera prise sur la base du pays avec lequel les parties ont les connexions les plus profondes. Les instances de divorce sont gouvernées par le Domicile and Matrimonial Act 1973, qui dispose que les Cours anglaises et galloises ont juridiction afin de traiter les demandes de divorces auxquelles l’une ou plusieurs des conditions suivantes s’appliquent :
- Les deux parties au mariage ont leur résidence habituelle en Angleterre ou au Pays de Galles ;
- Les deux parties au mariage ont eu leur dernière résidence habituelle en Angleterre ou au Pays de Galles et l’une des partie continue de résider dans l’un de ces deux pays ;
- Le défendeur a sa résidence habituelle en Angleterre ou au Pays de Galle ;
- Le demandeur a sa résidence habituelle en Angleterre ou au Pays de Galles et y a résidé minimum un (1) an immédiatement avant l’initiation de la procédure de divorce ;
- Le demandeur est domicilié et a sa résidence habituelle en Angleterre ou au Pays de Galles et y a résidé minimum six (6) mois immédiatement avant l’initiation de la procédure de divorce ;
- Les deux parties au mariage sont domiciliées en Angleterre ou au Pays de Galles ; ou
- Une des parties au mariage est domiciliée en Angleterre ou au Pays de Galles.
Qu’est-ce-que la « résidence habituelle » ?
Une personne peut seulement être « résident habituel » à un endroit unique et à un temps donné. L’essence de la « résidence habituelle » repose sur le « centre d’intérêt » de la vie de la personne concernée. Il convient de noter que la « résidence habituelle » dans un pays n’est pas nécessairement perdue si la personne a résidé dans un autre pays pour une durée importante et qu’il n’y a aucune exigence que le « centre d’intérêt » mentionné ci-dessus soit permanent ; il nécessite seulement d’être habituel, mais doit également présenter un caractère de stabilité.
Qu’est-ce-que le « domicile » ?
Le « domicile » est un concept plus universel. Une personne est dite « domiciliée » dans un pays où elle possède un foyer permanent. Tout le monde possède un domicile et chacun ne peut avoir qu’un domicile opératoire à la fois.
Reconnaissance de votre procédure de Divorce en dehors du Royaume-Uni
Si votre divorce a été prononcé ou initié au Royaume-Unis avant le 31 Décembre 2020, tout Etat Membre ressortissant de l’UE sera en mesure de reconnaitre la décision prononcée. Cependant, afin de s’assurer de la certitude de la reconnaissance mutuelle d’un Etat Membre à un autre, il convient d’obtenir un Certificat de Reconnaissance dès que possible. Particulièrement si vous vous préparer à partir vivre ou travailler dans un autre Etat Membre que celui dans lequel le divorce a été prononcé.
Si votre procédure de divorce a été initiée après le 1er Janvier 2021, certain Etats Membres de l’UE peuvent être dans l’impossibilité de reconnaitre la prononciation de votre divorce. Douze des vingt-sept Etats Membres de l’UE ont signé La Convention de La Haye sur la reconnaissance des divorces et des séparations de corps.
Ainsi, les pays suivants reconnaitront une procédure de divorce initiée au Royaume-Uni :
- Chypre
- République Tchèque
- Danemark
- Estonie
- Finlande
- Italie
- Luxembourg
- Pays-Bas
- Pologne
- Portugal
- Slovaquie
- Suède
